Children's unlimited imagination allows considering almost any object a toy. However, toys are products targeted to a special group of consumers – children. Therefore, in order to prevent a risk to children's safety and health created by toys, there are specific requirements for toy safety set in the European Union.

All the toys offered on the European Union market shall be labelled with the CE mark – it means that the toy conforms to the essential safety requirements and the manufacturer has carried out its conformity assessment.

European Parliament and Council Directive 2009/48/EC on the safety of toys of 20 July 2009 has to be fully applied in all member states as of 20 July 2013.

Legislation regulates:

  • general and particular safety requirements for toys that are offered on the EU market

  • the manufacturer's responsibility for the safety of toys and application of the conformity assessment procedures set out in the Directive. Toy safety assessment must be carried out by the manufacturer, before placing a toy on the European market, and it is a mandatory obligation of each manufacturer. The safety assessment must cover a wide range of hazards that the toy could create – chemical, physical, mechanical, electrical, flammability, hygiene and radioactivity hazards

  • obligations of the manufacturer, his/her authorized representative or the importer prior to placing the toy on the market, including carrying out an assessment of toy safety

  • CE certification of toys – toy EC-type examination procedures
